Agreeing to these terms

These terms apply when you use this website, ask Masterwork Tuscaloosa Concrete for an estimate or hire us for concrete work. By using the site or booking a job with us, you agree to them.

If a signed estimate or contract for your job says something different from these terms, the signed document controls for that job. If you don't agree with these terms, please don't use the site. You can still call us at (205) 579-1212 with questions.

What we do

Masterwork Tuscaloosa Concrete is a concrete contractor in Tuscaloosa, AL. We build driveways, patios, sidewalks, steps, slabs, footings, retaining walls and other concrete work for homes and businesses in Tuscaloosa and the cities around it. Our home page lists the services we offer, and our about us page explains how we work.

The information on this site is general. It describes how concrete work usually goes, but it isn't engineering, legal or permit advice for your property. Your job is defined by your written estimate, and we only confirm details after we've seen the site.

Estimates and pricing

We give free estimates at your property, and asking for one doesn't obligate you to anything. An estimate is based on what we can see and measure that day, including the size of the area, access for trucks and equipment, the ground the slab will sit on, drainage and the finish you choose.

A written estimate is good for the period stated on it. After that, material and labor costs may have changed, so we may need to update it before we schedule the work.

Some conditions only show up once we dig. If we find soft or wet ground, old concrete, roots, rock, buried debris or anything else that changes the work, we'll stop, show you what we found and agree with you on any added cost before we go on. We won't charge you for extra work you haven't approved, unless it's needed right away to keep the site safe.

Scheduling, weather and cancellation

We give you a start date when you accept the estimate. Concrete depends on the weather, so rain, ground that's too wet, extreme heat or freezing temperatures can push the pour back. We'll move the date rather than pour in conditions that would weaken the slab, and we'll tell you as soon as we know.

Delays from weather, supplier problems, permit or inspection timing, or other things outside our control aren't a breach of our agreement with you. We'll reschedule at the earliest reasonable date.

If you need to cancel or reschedule, call us as early as you can. You can cancel before we order materials or start work without a charge, unless your written estimate says otherwise. If materials have been ordered, delivered or custom-made, or if work has started, you'll pay for the work done and for materials we can't return.

Payment

Your written estimate or contract sets out the price, any deposit and when each payment is due. Unless it says otherwise, the balance is due when the work is complete.

If payment isn't made when due, we may pause work and use any remedy Alabama law allows to collect what's owed, which can include a lien on the property where the work was done. We'd much rather talk it through, so call us if a payment problem comes up.

Your part of the job

You agree to give us safe access to the work area and to tell us before the job starts where any sprinkler lines, septic parts, buried cables, pipes or property lines are, as far as you know them. We're not responsible for damage to private lines or features we weren't told about and couldn't reasonably see.

Where your HOA, the city or the county has rules about your project, you're responsible for any HOA approval. We'll talk with you about permits for your job during the estimate.

New concrete needs time to cure, which is the wait while it hardens to full strength. You agree to keep foot traffic, vehicles and heavy loads off the slab for the times we give you, because using it too early can crack or mark it.

Our guarantee and what it doesn't cover

We stand behind our work, and if you're not satisfied, we want to hear about it so we can make it right. Any written warranty for your job will be stated in your estimate or contract, and that document sets out what it covers and for how long.

Concrete is a natural material, and some things are normal and not defects. These include small hairline cracks, slight differences in color or texture between pours, and surface changes from weather. We cut control joints, the planned grooves in the slab, so that cracks are most likely to form along those lines instead of across the surface.

No warranty covers damage from settling or movement of soil we didn't prepare, tree roots, flooding or water that's directed onto the slab after we leave, de-icing salts, heavy vehicles or equipment the slab wasn't built for, use before the curing time we gave you, or work done by others. Apart from any written warranty for your job, and to the extent the law allows, the website and our services are provided without other express or implied warranties.

Limits on our liability

To the extent Alabama law allows, Masterwork Tuscaloosa Concrete isn't liable for indirect, incidental or consequential losses, such as lost use of your property, lost income or the cost of other plans that were delayed. Our total liability for any claim connected with a job is limited to the amount you paid us for that job.

Nothing in these terms limits liability that the law doesn't allow to be limited, such as liability for our own gross negligence or willful misconduct. We're licensed and insured.

If we disagree

Most problems are solved with a phone call and a visit to look at the work together. If you have a concern, contact us first and give us a fair chance to look at it and respond. We reply within 1 business day.

If we can't settle it between us, both sides agree to try good-faith mediation before going to court, unless the matter needs urgent relief. Any lawsuit will be brought in the state or federal courts serving Tuscaloosa County, Alabama, and both sides agree to those courts hearing it.

Which law applies

These terms, and any work we do for you, are governed by the laws of the State of Alabama, without regard to rules that would apply another state's law.

Changes to these terms

We may update these terms from time to time, and the version posted on this page is the one in effect. Changes won't affect a job you've already signed for. That job stays under the terms in place when you accepted the estimate.

If any part of these terms is found unenforceable, the rest still applies.
